Welcome to Raw Billet CNC. These Terms of Service ("Terms") govern your use of our website rawbilletcnc.com (the "Site") and the purchase of CNC machining services from Raw Billet CNC ("we," "our," or "us"). By using our Site or services, you agree to these Terms.
1. Services
Raw Billet CNC provides precision CNC machining services, including but not limited to milling, prototyping, small-batch production, 3D scanning, reverse engineering, and finishing services for specialty materials such as titanium, aluminum 6061, aluminum 7075, and other engineered alloys.
2. Quotes and Orders
2.1 Quote Requests
When you submit a quote request through our Site or by contacting us directly, we will review your project specifications and provide a quote within 24 hours during business hours (Monday–Friday, 8am–6pm CT).
2.2 Acceptance of Quotes
Quotes are valid for 30 days from the date issued unless otherwise specified. A quote becomes a binding order when you provide written acceptance (email confirmation or signed purchase order) and we acknowledge receipt.
2.3 Changes to Orders
Any changes to an accepted order must be requested in writing and are subject to our approval. Changes may affect pricing, delivery timeline, and specifications.
3. Pricing and Payment
3.1 Pricing
All prices are quoted in U.S. Dollars (USD) and are subject to change without notice. Quoted prices are based on the specifications provided at the time of the quote.
3.2 Payment Terms
Payment terms will be specified in each quote or invoice. Unless otherwise agreed in writing, payment is due within 30 days of invoice date. We accept payment by bank transfer, check, or credit card.
3.3 Late Payments
Late payments may be subject to interest charges of 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is lower.
4. Materials and Specifications
4.1 Customer-Provided Specifications
You are responsible for providing complete and accurate technical drawings, CAD files, material specifications, tolerances, and any other requirements necessary to complete your project. We will machine parts according to the specifications you provide.
4.2 Material Certification
Material certifications are available upon request and may be subject to additional fees. Unless specifically requested, material certifications are not included in standard pricing.
4.3 Design Review
While we may offer suggestions for manufacturability, you retain sole responsibility for the design, fitness for purpose, and functionality of your parts. We are not liable for design defects or unsuitability for intended use.
5. Production and Delivery
5.1 Lead Times
Estimated lead times are provided in good faith but are not guaranteed. Actual delivery dates may vary due to material availability, production schedules, or unforeseen circumstances.
5.2 Shipping
Unless otherwise agreed, shipping costs are additional and will be billed separately. Risk of loss or damage passes to you upon delivery to the carrier.
5.3 Inspection and Acceptance
You must inspect all parts within 5 business days of receipt and notify us in writing of any defects, shortages, or non-conformities. Failure to notify us within this period constitutes acceptance of the parts.
6. Quality and Warranties
6.1 Workmanship Warranty
We warrant that our machining services will be performed in a professional and workmanlike manner in accordance with the specifications you provide. This warranty is valid for 30 days from delivery.
6.2 Tolerances
Unless tighter tolerances are specified and agreed upon in your quote, standard machining tolerances apply: ±0.005" for general features, ±0.001" for critical dimensions when specified.
6.3 Limitation of Warranty
THE WARRANTIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
7. Liability and Indemnification
7.1 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM.
7.2 Exclusion of Consequential Damages
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.
7.3 Customer Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from: (a) your designs, specifications, or materials; (b) your use of the machined parts; or (c) your violation of these Terms or applicable law.
8. Intellectual Property
8.1 Customer IP
You retain all intellectual property rights in your designs, drawings, and specifications. We will not use your confidential information except as necessary to provide our services.
8.2 Portfolio Use
Unless you explicitly request otherwise in writing, we reserve the right to photograph and use images of completed parts for portfolio, marketing, and promotional purposes, without disclosing your identity or proprietary information.
9. Cancellation and Returns
9.1 Cancellation by Customer
You may cancel an order before production begins with written notice. If production has started, you will be responsible for costs incurred up to the point of cancellation, including materials, labor, and setup costs.
9.2 Returns
Custom-machined parts are made to your specifications and are generally non-returnable unless defective or non-conforming. Defective parts must be returned within 30 days for inspection and evaluation.
10. Confidentiality
We will treat your technical information, designs, and business information as confidential and will not disclose it to third parties except as necessary to fulfill your order or as required by law.
11. Force Majeure
We shall not be liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, material shortages, or government actions.
12. Governing Law and Disputes
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
12.2 Dispute Resolution
Any disputes arising out of or relating to these Terms or our services shall be resolved through good faith negotiation. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Williamson County, Texas.
13. General Provisions
13.1 Entire Agreement
These Terms, together with any quotes, purchase orders, and invoices, constitute the entire agreement between you and Raw Billet CNC regarding our services.
13.2 Modifications
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
13.3 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13.4 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
